Acceptable use policy

Scope
This policy applies to everyone who uses FreeUpscaler, alongside the terms of use. FreeUpscaler enhances images and video you supply: it has no prompt and does not make new scenes, but the AI models can add plausible detail. The rules below cover what you may put through it and what you may do with the result. They apply to the free local tools as much as to the cloud models — the difference is only that we can check what reaches the cloud, and cannot see what stays on your device.
Prohibited content
Do not upload, enhance or distribute an enhanced version of any of the following.
- Sexual content and nudity. Pornography, sexually explicit material and nude imagery, whatever its framing.
- Violence and gore. Graphic violence, gore or mutilation, and material that glorifies or incites violence, including terrorist and violent extremist propaganda.
- Hate. Material that attacks, demeans or incites hatred against people for their race, ethnicity, nationality, religion, caste, sex, gender identity, sexual orientation, disability or serious illness.
- Child safety. Child sexual abuse material, and anything that sexualises, exploits or endangers a minor.
- Deepfakes and impersonation. Using an enhanced image or video of a real person to deceive, impersonate, harass or defame them; sexual or intimate imagery of anyone without their consent; and passing manipulated media off as authentic evidence, documents or news.
- Copyright and trademark infringement. Material you do not own or have the right to use, including other people’s films, photographs and artwork, and uses that infringe a trademark or a person’s privacy or publicity rights.
Three of these are zero tolerance: child sexual abuse material, non-consensual intimate imagery including deepfakes, and terrorist propaganda. One instance closes the account for good, and child sexual abuse material is reported to the US National Center for Missing & Exploited Children and to law enforcement.
Prohibited uses
Do not use FreeUpscaler to defraud, harass or threaten anyone; to forge identity documents or other records; to get around the limits on the cloud models, abuse the sign-up credits with multiple accounts, or resell access; or to interfere with the service or the people using it.
How cloud files are checked
Every file sent to a cloud model is checked automatically after it is uploaded and before it is upscaled or any credit is taken. The check is fal’s NSFW classifier (fal-ai/x-ailab/nsfw): an image is checked as it is; a video is checked on three of its keyframes — the first, the one nearest the middle and the last — which we cut out of the file, keep only for the length of the check, and have fal’s frame extractor turn into images that fal is instructed to delete within ten minutes. A file the check flags is refused, nothing is charged, and the refusal is recorded against the account — when and with which model, never the file. If the check itself cannot run, the run is refused rather than let through unchecked.
The check is on the input because that is where the content comes from: an upscale has no prompt, and its result is the same picture at a higher resolution. Its limits, plainly: the classifier detects sexual content only, and three frames cannot show everything in a video. Everything else on the list above is enforced through reports and human review. Results are private to the account that made them — nothing is published on FreeUpscaler — so misuse usually comes to light outside the site, through a report.
Refusals and reports are reviewed by a person, not a model. Recorded refusals are reviewed regularly, and an account that keeps submitting flagged files is acted on even without a report.
Reporting misuse
Report a violation — content made with FreeUpscaler, misuse of your own image or work, or a refusal you think was wrong — by emailing support@freeupscaler.net with “Report” in the subject. Say what the content is, where you found it, and why it breaks this policy; do not attach sexual material involving a minor — describe it and where it is. Reports are kept confidential: the account reported is not told who reported it.
Reports of child sexual abuse material or non-consensual intimate imagery are dealt with first, within 24 hours; everything else within five business days. If a child is in immediate danger, contact local police or the NCMEC CyberTipline at report.cybertip.org directly.
What happens when the rules are broken
Depending on how serious the violation is and whether it is repeated, we may:
- refuse the file — the automatic check does this before a credit is taken;
- warn the account holder by email, for a first minor violation;
- delete the results concerned from our storage;
- suspend the account’s access to the cloud models, for repeated or serious violations;
- close the account, for a zero-tolerance violation or repeated serious ones — remaining credits are forfeited without a refund, as the terms of use set out;
- report to and cooperate with law enforcement where the law requires it.
The local tools need no account, so there is no access to suspend there; what you do with them is your responsibility under the same rules.
Appeals
If you think a refusal or an action against your account was wrong, reply to our email or write to support@freeupscaler.net within 30 days. A person looks at it again and answers within five business days. A zero-tolerance violation confirmed on review is not reversed.
Changes
A material change to this policy is posted here at least 14 days before it takes effect. The date at the top says when it last changed.
